Ushr on Fruit Orchards, Dates and Raisins

Question

How is ushr assessed on fruit trees, date palms and grapes/raisins, and when?

Ruling (Fatwa)

Short answer: Ushr (zakat on agricultural produce) is assessed on dates and grapes (and other fruit crops) based on the method of irrigation. The rate is one-tenth (10%) for land irrigated by rain, natural springs, or rivers, and one-twentieth (5%) for land irrigated by manual means (e.g., well or pump). It becomes due at the time of harvest. Evidence: 1. Sahih al-Bukhari 1483: The Prophet (ﷺ) said, 'On a land irrigated by rain water or by natural water channels or if the land is wet due to a nearby water channel Ushr (i.e. one-tenth) is compulsory; and on the land irrigated by the well, half of an Ushr (i.e. one-twentieth) is compulsory.' This general ruling covers all agricultural produce, including dates and grapes. 2. Surah Al-Baqarah 2:267: 'O you who believe! Spend of the good things which you have (legally) earned, and of that which We have produced from the earth for you.' This includes dates and grapes as produce of the earth. Note: The provided passages did not contain a specific hadith listing dates or grapes as subject to Ushr, but the general principle from the hadith of irrigation applies.
