1. Acceptance of Terms
These Terms and Conditions ("Terms") govern your access to and use of the Smart Gold Trade platform ("Platform") operated by Smart Gold Trade Limited ("Company", "we", "us"). By accessing the Platform or using any of our services, you agree to be bound by these Terms.
These Terms apply to all services including spot gold trading, Mudarabah investment plans, Musharakah partnership pools, gold vault and store, copy trading, referral programme, zakat tools, and wallet services.
If you do not agree with any part of these Terms, you must not use the Platform.
2. Services Description
Smart Gold Trade Limited provides a comprehensive Shariah-compliant gold ecosystem, including:
- Halal Gold Trading (XAUUSD): Buy and sell gold on a spot basis with 1:1 leverage, no swap, no interest.
- Mudarabah Investment Plans: Shariah-compliant profit-sharing investment plans managed by the Company.
- Musharakah Partnership Pools: Joint-venture investment pools with proportional profit and loss sharing.
- Gold Vault: Physical gold allocated locally in the Client's name with secure office locker and City Bank custody.
- Gold Store: Purchase of physical gold products (bars, jewelry) with delivery or vault storage options.
- Copy Trading: Follow and automatically copy the trades of expert Master traders.
- Referral Programme: Earn Ujrah (service fee) from Company income by introducing new clients. Live paying depth is the configured Referral Settings max_levels (currently two: L1 direct and L2 indirect). There is no unlimited-depth chain. Rates are those shown on the Referral dashboard.
- Zakat Calculator: Educational tool to calculate Zakat on gold holdings.
- Wallet Services: USD wallet for deposits, withdrawals, and transfers between services.
3. Shariah Compliance
3.1 Core Principles
All Smart Gold Trade Limited products and operations are governed by Islamic finance principles and are regularly reviewed by an independent Shariah Advisory Board. The following are strictly observed:
- No Riba: No interest, swap, or overnight financing is charged or earned on any account or transaction.
- No Gharar: All product terms, profit-sharing ratios, fees, and risks are fully disclosed before the Client commits.
- No Maysir: No speculative derivatives, binary options, or gambling-like products are offered.
- 1:1 Leverage only: No borrowed capital is provided. You trade only what you can fully fund.
- Halal assets only: All trading and investment is in gold and other Shariah-permissible assets.
3.2 Shariah Advisory Board
All products, fee structures, and operational practices are reviewed by the Company's Shariah Advisory Board. Shariah compliance documents are available upon request for individual products.
3.3 Not a CFD Broker
4. Account Registration & Security
4.1 Eligibility
- You must be at least 18 years of age.
- You must provide accurate, complete, and current information during registration.
- Only one account is permitted per individual. Duplicate accounts will be suspended.
4.2 Account Security
- Keep your password and two-factor authentication codes confidential.
- Do not share account access with any third party.
- Notify us immediately if you suspect unauthorised access to your account via the Support Ticket system.
- SGT will never ask for your password by email, phone, or any other channel.
4.3 KYC Verification
You may be required to complete Know Your Customer (KYC) verification before making withdrawals or accessing certain services. This includes proof of identity and proof of address. We reserve the right to request additional documentation at any time.
5. Gold Trading Terms (XAUUSD)
5.1 Contract Specification
- Instrument: XAUUSD (Gold vs US Dollar)
- Trading Unit: grams of gold. There is no lot. Volume is stated in grams to four decimal places, and prices are quoted in US dollars per gram. (A standard broker's lot is 100 troy ounces — about 3,110 grams — and is a contract for difference rather than metal.)
- Minimum Volume: $1.00 worth of gold. The floor is a cash amount, not a weight, so it does not move with the gold price. The smallest quantity the platform will record is 0.0001 gram.
- Commission: a declared fee of $2.00 per gram BUY and $2.00 per gram SELL, charged on the buy and again on the sell. The current rate, the cost of the gold and the total to be debited are all shown before you confirm an order. No markup is applied to the quoted price — zero spread (bid = ask = spot).
- Leverage: 1:1 — full margin required; no borrowed capital
- Swap / Overnight Interest: Zero — completely Riba-free
5.2 Order Types
Market orders, limit orders, and stop-limit orders are supported. Orders are executed at the best available price. In fast-moving market conditions, slippage may occur; the Company does not manipulate execution prices.
5.3 Demo Accounts
Demo accounts are provided with $10,000 in virtual (practice) funds. No real money is involved. Demo results do not predict live trading outcomes.
5.4 Trading Risk
Gold prices fluctuate continuously. The value of an open position can fall, and you may lose part or all of your invested capital. Past performance is not indicative of future results.
5.5 Local Allocation & Sell Lock (5–7 Minute Window)
On every client BUY order, physical gold is allocated locally in your name. Placing the purchased gold into your designated locker takes approximately 5–7 minutes. To ensure actual Shariah possession (Qabd) before sale and prohibit unbacked fictitious trading, you cannot sell or close an open position until this 5–7 minute allocation window passes. Once allocated and matured, your position can be closed or sold at live market prices.
6. Investment Plans
6.1 Mudarabah Plans
Mudarabah is an Islamic profit-sharing contract. You (Rab-ul-Mal) provide capital; the Company (Mudarib) manages the investment. Profits are shared at the active plan's pre-agreed ratio: Shams Al-Dhahab — 70% investor / 30% Company; Qasr Al-Sultan — 80% investor / 20% Company (prior plan Badr Al-Kamal was withdrawn on 2026-09-04 and is not offered). In the event of a loss, you bear the capital loss; the Company bears the loss of effort (absent proven negligence or misconduct). Returns are not guaranteed.
6.2 Musharakah Pools
Musharakah is an Islamic joint-venture contract. The Company and Client both contribute capital. Profits are shared by agreed ratio (default: 30% Company / 70% Client Partners) and losses are shared strictly by capital contribution % (the Company contributes a target 30% capital stake and absorbs 30% of any loss directly from its capital). The Company does not charge a management fee on capital or in loss periods. Each pool has a defined lock-in period; early withdrawal may result in profit forfeiture.
6.3 No Guaranteed Returns
6.4 Withdrawals from Investment Plans
Funds committed to an active Mudarabah cycle or within a Musharakah lock-in period cannot be withdrawn until maturity. Requests for early exit are handled on a case-by-case basis and may incur a forfeiture of the current cycle's profit.
7. Gold Vault & Store
7.1 Physical Gold Ownership & Local Allocation
Gold purchased through the SGT Vault, Store, or Spot Trading represents actual physical gold allocated locally in your name. You are the sole legal owner of the gold. Custody is maintained in our office locker facility and through our institutional custody partnership with City Bank, with insurance coverage fully in place. The Company owns and maintains proprietary physical gold reserves alongside dedicated physical gold held as active trading inventory, as maintained in the Company’s official ledger and displayed on the live Company Reserves panel, distinct and segregated from Client-allocated gold.
7.2 Storage Fees
Storage of client gold in the vault is currently free / waived until a formal Shariah Ujrah (safekeeping fee) schedule is published with advance notice. All stored gold holdings remain fully insured.
7.3 Buyback & Allocation Window
SGT offers a buyback facility at the prevailing live market rate. Newly bought gold completes a 5–7 minute local allocation and locker placement window before it can be sold. Once allocated, you may sell your gold back to cash at any time. No specific buyback price above the prevailing market rate is guaranteed.
7.4 Physical Delivery
Physical delivery of gold may be requested subject to minimum quantities, delivery fees, shipping charges, and applicable customs duties in your jurisdiction. Delivery timeframes vary by location.
7.5 Gold Gifting
Gifting transfers actual gold ownership to the recipient's SGT account. Gifted gold cannot be reversed once accepted by the recipient. The gift transaction is a Shariah-compliant ownership transfer.
8. Copy Trading
Copy trading allows you (Follower) to automatically replicate the trades of a Master trader. By enabling copy trading, you acknowledge that:
- Past performance of any Master trader does not guarantee future results.
- You bear full trading risk on all copied positions.
- Each Master sets their own performance fee at application (maximum 50%). You see that Master's rate on their page before you follow. The fee is taken from your new profits only — not your capital and not in a loss period. A $0 copy subscription does not mean a $0 performance fee.
- The platform retains a configured share of that Master's performance-fee pool (not an extra charge on you). The live cut is shown on Copy Trading pages; the Master receives the remainder.
- You may stop copying a Master at any time; open copied positions remain in your account until closed.
- Copy trading does not constitute financial advice. SGT does not endorse any Master trader.
9. Promotions & Hibah
9.1 What the Platform Currently Credits

9.2 What Is Not Currently Offered
The Platform does not currently operate a cash Welcome Bonus, a percentage Deposit Bonus, a volume-conditioned trading credit, a promo-code cashback, or an annual referral performance bonus. Trading-account "credit" that inflates buying power without being the Client's own wallet money is not used. There is no guaranteed-profit bonus and no interest rebate.
9.3 Daily Amal Hibah Conditions
- Eligibility, per-task grams, daily caps, and the Gold Wallet transfer threshold are those shown in the Daily Amal module at the time of the task. The Company may amend those settings with notice on the module.
- Pending Daily Amal gold is not cash and cannot be withdrawn as USD. After transfer to the Gold Wallet it is gold in that wallet, subject to ordinary Gold Wallet and withdrawal rules.
- Missing a task resets that task’s counter as shown in the module. The module does not debit gold already transferred to the Gold Wallet for a missed day.
- The Company may suspend or withhold a Daily Amal credit for abuse, duplicate accounts, device sharing, or other breach of module or Platform rules.
9.4 Future Promotional Hibah
If the Company later announces a cash or gold promotional Hibah, eligibility, wallet destination, and any claw-back will be published with that announcement and may be amended with notice. No unpublished programme is a contractual entitlement.
9.5 Non-Transferability
Daily Amal credits and any future promotional Hibah are personal to the account to which they are granted and may not be transferred to another person unless the Company expressly permits it in writing.
10. Wallet Services
SGT provides a USD wallet for each Client. The wallet is used for:
- Depositing funds into the Platform
- Funding trading accounts and investment plans
- Receiving profits, Referral Ujrah, and Daily Amal gold Hibah after it has transferred to the Gold Wallet
- Withdrawing funds to external payment methods
Wallet balances are denominated in USD. Transfers between the wallet and Platform services are subject to applicable terms and are processed immediately.
11. Fees & Charges (Riba-Free)
- Gold Trading: Zero spread (bid = ask = spot price). Commission: $2.00 per gram BUY + $2.00 per gram SELL, disclosed prior to order confirmation. Zero swap.
- Mudarabah: Company's profit share % as defined per plan — on profits only.
- Musharakah: Profit share per agreed ratio (30% Company / 70% Clients). Losses shared strictly proportional to capital (Company absorbs 30% of loss). No management fee.
- Copy Trading: Per-Master performance fee (set at application, maximum 50%) from the Follower's new profits only, disclosed on that Master's page before follow. No copy subscription fee. Platform retains a configured share of that fee pool.
- Gold Vault Storage: Free / waived (no storage fee charged until a formal Ujrah schedule is published).
- Withdrawals: Fees disclosed at time of withdrawal request.
- Dormant Account: $5/month after 12 months of inactivity (positive balance only).
All fees are service-based and do not involve interest or Riba. A complete fee schedule is published on the Platform and updated with advance notice.
12. Deposits & Withdrawals
12.1 Deposits
- Deposits are accepted via the payment methods listed on the Platform. Minimum deposit amounts apply per service.
- Funds are credited after confirmation from the payment processor. SGT is not liable for delays caused by third-party processors.
- SGT reserves the right to request source-of-funds documentation for large deposits.
12.2 Withdrawals
- Withdrawals are processed to the Client's verified payment method only. Third-party withdrawals are not permitted.
- KYC verification must be complete before the first withdrawal.
- Standard processing time: 1–5 Business Days, subject to compliance review.
- Funds locked in active investment cycles or within Musharakah lock-in periods cannot be withdrawn until maturity.
12.3 Refunds
Refunds are handled in accordance with the Refund Policy. Trading losses and investment losses are not refundable as they result from market activity.
13. Prohibited Activities
You agree not to:
- Use the Platform for illegal purposes, money laundering, or terrorist financing.
- Manipulate prices or engage in abusive trading practices.
- Create multiple accounts to circumvent limits, abuse promotions or Daily Amal, or gain unfair advantage.
- Share or sell account access with any unauthorised person.
- Use automated bots or scrapers without the Company's written consent.
- Attempt to hack, reverse-engineer, or disrupt the Platform.
- Provide false or misleading information at any stage.
- Engage in any activity that violates applicable laws in your jurisdiction.
14. Intellectual Property
All content, branding, logos, software, data, and materials on the Platform are the intellectual property of Smart Gold Trade Limited or its licensors. You may not reproduce, distribute, modify, or create derivative works from any Platform content without our prior written permission.
15. Limitation of Liability
To the maximum extent permitted by law, Smart Gold Trade Limited shall not be liable for:
- Losses arising from gold price movements, market volatility, or investment performance.
- Losses resulting from the Client's own trading or investment decisions.
- Service interruptions caused by Force Majeure events, third-party failures, or internet issues.
- Losses arising from the Client's failure to secure their account credentials.
- Indirect, consequential, or punitive damages of any kind.
Where SGT is found liable for direct losses caused by its own negligence, liability is capped at the total fees paid by the Client to SGT in the 12 months preceding the claim.
16. Indemnification
You agree to indemnify and hold harmless Smart Gold Trade Limited, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your breach of these Terms, or your violation of any applicable law.
17. Termination
SGT may suspend or terminate your account with immediate effect if you violate these Terms, engage in fraud or illegal activity, fail to complete KYC, or if a court or regulatory authority requires it.
You may close your account at any time by submitting a request via the Support Ticket system. All open positions must be closed and all active investment cycles must have completed before the account can be fully closed. Any remaining balance will be returned to your verified payment method.
18. Dispute Resolution
- Support Ticket: Submit a complaint via the Support Ticket system in your dashboard. SGT acknowledges within 2 Business Days and resolves within 10 Business Days.
- Shariah Board Escalation: For matters relating to Islamic finance compliance, unresolved complaints may be escalated to the Company's Shariah Advisory Board.
- Arbitration: Disputes that cannot be resolved amicably shall be settled by binding arbitration under rules agreed upon by both parties.
19. Changes to Terms
SGT may update these Terms at any time. Material changes will be communicated via email and/or in-platform notification at least 30 days before the changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms.
20. Governing Law & Contact
These Terms are governed by Islamic finance principles as reviewed by the Company's Shariah Advisory Board, alongside applicable commercial law. Any disputes not resolved under Section 18 shall be subject to the jurisdiction disclosed in the Client Agreement.
