Owning Gold and Silver Utensils: Ruling and Zakat
Question
Is it permissible to own gold or silver plates and cutlery, and is zakat due on them?
Ruling (Fatwa)
Short answer: Using gold and silver vessels for eating and drinking is prohibited, and owning them for that purpose is also prohibited. If one possesses them, zakat is due on them if they reach the nisab and are owned for a full lunar year.
Details:
1. Prohibition of Use: The Prophet ﷺ explicitly forbade drinking from gold or silver vessels and eating from their plates (Sahih Muslim 2067). This prohibition covers both men and women. Owning such vessels for the purpose of using them is included in this prohibition, as the vessels are intended for use. Therefore, it is not permissible to own gold or silver plates, cutlery, or any similar utensils for eating or drinking.
2. Zakat Obligation: Gold and silver, regardless of their form, are wealth subject to zakat if they reach the nisab. The nisab for silver is 5 awqiya (approximately 595 grams or 200 dirhams), as stated in Sahih al-Bukhari (1447, 1405, 1459). For gold, the nisab is 20 mithqal (approximately 85 grams), derived from other authentic hadith (not included in the supplied evidence but universally accepted). The Qur'an (At-Tawbah 9:34-35) and hadith (Sahih Muslim 987a) warn of severe punishment for those who hoard gold and silver without paying zakat. Hence, if one owns gold or silver vessels that reach the nisab and are owned for a full year, zakat must be paid on their market value. The prohibition of using them does not exempt them from zakat, as the obligation is on the wealth itself.
Evidence:
1. Sahih Muslim 2067 – Prohibition of using gold/silver vessels for drinking and eating.
2. Sahih al-Bukhari 1447 – No zakat on less than five awqiya of silver; establishes nisab for silver.
3. Sahih Muslim 987a – Warning of punishment for not paying zakat on gold and silver.
4. Surah At-Tawbah 9:34-35 – Condemnation of hoarding gold and silver without paying zakat.
Note: This is a simplified ruling based on the provided evidence. For complex cases (e.g., vessels used as investment or for decoration), consult a qualified scholar.
